American Fly Fishing Co., Inc, and their officers, directors, shareholders, employees and agents, hereafter collectively AFFC, operate a web-site which, among other things, advertises fly fishing lodges, fly fishing vacation rental properties, private waters fishing and fly fishing guide services at the request of the Owners thereof.

The term “Owner” as used herein includes the fly fishing lodge owner, the vacation rental property owner, the private waters owner, and the fly fishing guide service owner and a manager or other person acting as an agent of and on behalf of any such owner.

By advertising with AFFC, Owner acknowledges that there is no agency relationship created between Owner and AFFC, and that AFFC is not a travel agent, a real estate agent, a rental agent, or otherwise acting as an agent for or on behalf of Owner.

The term “Guests” as used herein means persons who book direct with Owner. AFFC is not responsible and has no liability for Guests who book direct with Owner. It is the sole responsibility of the Owner to conduct his/her own investigation regarding potential Guests and to validate their qualifications. Owner assumes all responsibility and liability of every kind and nature for Guests and agrees to hold AFFC free and harmless therefrom. Owners are responsible for investigating and adhering to all local, state, and federal laws and regulations including, but not limited to, permits, licenses, occupancy taxes, insurance, and safety compliance. Owner acknowledges that potential Guests will contact Owner directly by email.

The AFFC web-site may contain links to web-sites operated by parties other than AFFC. AFFC does not control such web-sites and is not responsible for their content. AFFC's inclusion of links to such web-sites does not imply any endorsement of the material or any association with their operators. AFFC has the right to remove links or disallow links at its discretion. AFFC shall have no liability whatsoever for the web-sites linked to their web-site.

Owner assumes all responsibility and liability for the inclusion of their advertisement and any photographs thereof on the AFFC web-site and agrees to hold AFFC free and harmless therefrom. Owners affirmatively represent that they have the legal right to cause such advertisements and photographs to be published and that such photographs accurately represent their fly fishing lodge, fly fishing vacation rental property, private fishing waters or fly fishing guide service.

AFFC assumes no responsibility for the accuracy of the information provided by Owner and published on the AFFC web-site. Owner affirmatively represents that he/she has verified the accuracy of the information provided to AFFC and published on its web-site and that all such statements are true and agrees to hold AFFC free and harmless from any liability arising from the inaccuracy of such information.

Owner acknowledges that AFFC has the sole and exclusive right to control the content on its web-site and to remove any content therefrom if, in its determination, such content violates its guidelines or policies. AFFC also has the right to remove any content from its web-site that is in breach of any representation made by Owner herein.

Guest inquires are sent by email and are not to be considered private. Internet e-mail delivery is not always reliable and AFFC cannot be responsible for inquiries that are not delivered or for lost income as a result of undelivered inquiries. Owner hereby releases AFFC from any and all claims and liability that may arise from the failure of delivery of email Guest inquires.

If AFFC is unable to provide the promised level of service for any reason, including, but not limited to service outages, war, acts of God or negligence, AFFC shall not be liable for any costs beyond the prorated costs paid by the Owner for the services which were not provided. AFFC does not guarantee that its web-site will be available 100% of the time.

This Agreement shall be construed in accordance with the laws of the State of California any and all disputes shall be submitted to binding arbitration according to the laws of the State of California. Venue for any such arbitration shall be in Sacramento, California.

By using the services provided by AFFC, Owner agrees to all of the terms and conditions set forth above.
